Use of the TrustVet Services are governed by either the “Clinic Terms and Conditions” and “Contract for Service”, if you are a subscribed veterinary practice, or the “Terms and Conditions of Use” if you are a subscribed pet owner .

The Website is offered to you conditional on your acceptance of these Website Terms and Conditions and any notices contained in these Website Terms and Conditions and on the Website itself. By accessing or using the Website, you agree to be bound by the terms, conditions and notices set forth below. If you do not wish, or agree, to be bound by these terms, conditions and notices do not access or use the Website.

You understand that TrustVet cannot and does not guarantee or warrant that files available for downloading through the Website will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Website for the reconstruction of any lost data.
For the avoidance of doubt, in no event will TrustVet be liable for (i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the Website and/or Service, or any information, or transactions provided on the Website and/or Service, or downloaded from the Website and/or Service, or any delay of such information or service. This section of the Website Terms and Conditions does not affect claims relating to death or personal injury caused by negligence and does not limit or exclude any liability for fraudulent misrepresentation.
General
You agree that no joint venture, partnership, employment, agency relationship, or solicitor-client relationship exists between you and us as a result of this Agreement or your use of the Website and/or Service.
Our performance of this Agreement is subject to existing laws and legal process. You must not assign or otherwise transfer the Website Terms and Conditions, or any right granted under them, without our written consent. We may assign or subcontract any or all of our rights and obligations of the Agreement with you to a third party at any time, at our discretion, without notice to you.
Any failure by us to enforce or exercise any provision of the Website Terms and Conditions, or any related right, will not be a waiver of that provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Any rights not expressly granted in this Agreement are reserved.
We may provide you with notices, including those regarding changes to the Website Terms and Conditions, by email, regular mail, postings on the Website, or other reasonable means now known or developed in the future.

Changes to these Website Terms and Conditions
TrustVet may modify or replace these terms and conditions at any time and such modifications or replacements shall be effective immediately upon the posting of the modified or replacement terms and conditions on the site.
You understand and agree that your continued access or use of the site shall be deemed your conclusive acceptance of any such modified or replacement terms and conditions. You further agree that you will visit the site on a regular basis to review these terms and conditions so as to become aware of such modifications or replacements.

Applicable law
This Agreement shall all be governed and construed in accordance with the laws of Ireland applicable to agreements made and to be performed in Ireland. You agree that any legal action or proceeding between TrustVet and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Ireland. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred.

Information you provide to us upon registering for and purchasing our Services:When you register for and use TrustVet, you are providing us with information, which we collect. This information may include your name, billing and mailing address, email address, phone number, and credit card information. We use Stripe, a third-party intermediary to manage credit card processing. Stripe is an online payments company that has been audited by a PCI-certified auditor, and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available. Stripe is committed to and complies with all relevant data protection and privacy legislation within Ireland. Your data will be retained and maintained in accordance with the relevant Data Protection legislation.
Information you provide to us upon using our Services:When you use our Services to subscribe to a pet health care plan you provide us with information which we require in order to perform the Services. This information may your name, contact details and billing information.
Information from your use of the Website:This information may include IP Address, location information, date and time, session length, browser type, and any other action you might have taken to use and while using the Services.
Information you provide when you contact us:If you enter into correspondence with us, we will collect and retain such information as necessary in order to deal with your correspondence and adequately maintain our own records.
Cookies:
When you use TrustVet, we may store "cookies," which are strings of code, on your computer. We use these cookies to collect information about when you visit our Website, when you use the Services, your browser, your operating system, and other similar information. Most browsers allow you to block and delete cookies. However, if you block our cookies, our Services may not work properly. Like all websites, our servers automatically record 'log files' containing information about the volume and characteristics of our website traffic e.g. IP address, numbers of pages viewed, length of time spent on site. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
Third Parties: We are not responsible for privacy in relation to your interactions with third parties and this Privacy Policy does not cover your use of any third-party widgets, features, or websites or links to third-party websites or services. We encourage you to read, and satisfy yourself as to, the privacy policy of any third-party site you visit or service you use.
Testimonials:We may publish customer testimonials on our Website, which may contain personal information. We obtain consent to post the customer’s name along with their testimonial. To request the removal of your personal information from a testimonial, please email us at support@trustvet.com.
Social Media Widgets: Our Website may include social media features. These features may collect your IP address, which page(s) you are visiting, and may set cookies to make sure they function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy policy of the companies providing them.

We will explicitly ask you when we need information to identify you. We may require you to co-operate with our security checks before we disclose information to you.

If you are our customer and would like to access or delete information that you provided, you may do this by emailing us at support@trustvet.com. We will respond to your request within 30 days. We may decline to process unreasonable requests or requests that are not otherwise required by local law. If we consent to delete information which you provided, at your request, you may no longer be able to access the Services and no refund of fees shall be given in such circumstances.
You may request a copy of personal information which we hold about you under Section 4 of the Data Protection Acts 1988-2003. If you would like a copy of the information held on you please email us at support@trustvet.com. To protect your privacy we may require you to supply further information to verify your identity. There is a fee of €6.35 to process your request. Once you have paid the fee, you will be given the information within 40 days.
We will retain your information and the data that we process on your behalf for a reasonable period. The period may be for as long as your account is active, for as long as needed to provide our Services, for as long as necessary to comply with our legal obligations, or for as long as necessary to resolve disputes.
